The 2026 stove and refrigerator rule has a specific scope
California changed its habitability rules for stoves and refrigerators in 2026. The useful questions include when the agreement was entered, amended or extended, the housing category and whether a lawful refrigerator arrangement was requested. A casual bring-your-own-appliance statement does not explain all of those conditions.

Begin with the agreement and housing type
DRE's enacted-legislation summary explains that AB 628 applies to rental agreements entered into, amended or extended on or after January 1, 2026. It adds a working stove capable of safe cooking and a working refrigerator capable of safe food storage to the relevant habitability requirements. The summary identifies exclusions for specified housing types, including certain shared-kitchen arrangements. Do not decide coverage solely from the year the building was constructed or from a listing's informal label. Show the actual agreement and housing arrangement to a qualified adviser if application is disputed.
Read the own-refrigerator option carefully
The enacted rule permits a tenant-requested own-refrigerator arrangement only under specified conditions. DRE describes lease language acknowledging the landlord's requirement, the tenant's checked acknowledgement of requesting their own refrigerator and responsibility for its condition, and a route to end that choice with thirty days' written notice. The landlord cannot condition the tenancy on the tenant providing their own refrigerator. This is not the same as a blanket waiver of every appliance obligation. Do not assume that an old addendum or an oral instruction meets the current requirements.
Check the final enacted summary rather than an early article describing a proposal. During a legislative session, an appliance bill can change its conditions, exclusions or wording before it becomes law. A draft's age limit or broad waiver description may survive in search results after the final version takes effect. Keep the current DRE summary with the relevant lease clause, and ask a focused question about the term that conflicts. The important evidence is the enacted rule applied to this agreement, not the most frequently repeated headline.
Separate a recall from ordinary wear
DRE's summary also explains that a recalled stove or refrigerator is not treated as capable of the required safe function and describes a repair-or-replacement deadline after notice of the recall. If you suspect a recall, identify the exact appliance model and compare the official notice rather than relying on a similar photograph. Report the information through the verified management route and follow immediate product safety instructions. Do not continue using a hazardous appliance while debating who pays, and do not attempt electrical or gas repairs yourself.
Clarify the practical arrangement without overstating it
Ask which appliance is supplied, who owns it, who is responsible for maintenance and what happens if the tenant ends a permitted own-refrigerator arrangement. Keep these details distinct from preferences for a particular finish, capacity or premium feature. A duty to supply working equipment does not automatically entitle a household to its favourite model. If a dispute remains, seek local code-enforcement or legal guidance about the actual requirement and remedy. Buying an appliance yourself does not by itself establish that the purchase price can be deducted from rent.
A proposed bring-your-own clause
Illustrative example: a 2026 applicant is told that every tenant must supply a refrigerator. They compare the proposed clause with the enacted rule's tenant-choice conditions and ask for clarification before agreeing. They do not assume that a mandatory listing term becomes lawful merely because it appears in a lease.

Questions that come up
Does the rule guarantee a premium appliance?
No. The requirement concerns working equipment capable of the specified safe function, not a preferred brand or feature set.
Can I deduct a new refrigerator's price immediately?
Do not assume that purchase creates a deduction right. Resolve coverage, obligations and the applicable remedy with qualified help before reducing rent.
